Bmx back brakes not springing/working

So i have pad brakes and on the back 1 works and one doesn't, the one that doesn't work, when places in position it is automatically pulled towards the wheel causing the pad to rub the wheel as soon as i tighten it, I've tried taking it off an repositioning it, doing my cables looser and tighter an changing it round for one of my old front brake holders but it just does not stay off the wheel.
Please help

What kind of brake is it? U, V, side pull (caliper), other?

Well i think its a u brake by the looks of things, but heres some additional info i have even tried taking one of my front brake off as i didn't really want them on a bmx and replaced it with one of the back brake ones ( its the kind of arm thing that holds the wire and springs back and forth). But even still it just tightens straight onto the wheel as soon as i put it on properly.

As you can see the one side is okay and the other is just tight on the wheel so it can not move freely
