Definitely a unique frame design. So, would the part that goes past the seat post still be considered the top tube?

That is a good question John, but the fender looks like it is mounted to the bottom of the seat post tube (I could be wrong).

After further inspection of the photo, it looks like you are right. It does attach to the seat post.

I tried this bike, its pretty heavy.... Why didn't you go for firefox, design is not enough.... Hercules is a good manufacturer... if you have low budget...
